Lee County Circuit Judge Edward Volz Jr. has denied a motion to move the trial of a Lehigh Acres man, who was charged with raping and killing his 13-year-old stepdaughter in 2006, but did delay the start of the trail in Lee County until March 31. The judge made the ruling on Feb. 19. Alberto Hernandez, 41, was charged with first-degree murder, sexual battery on a member of his family and aggravated child abuse in the death of Michelle Fontanez. If convicted, Hernandez could fact Florida’s death penalty.
