A Cape Coral City Council member is under investigation by the Lee County Sheriff’s Office and the school board.

Tony Schall, a public information officer for the sheriff’s office, said a criminal investigation involving District 6 Councilmember Tim Day is under way.

Though he could not go into specifics Monday night, Schall said the investigation is separate from one being conducted by the Lee County School Board.

“The investigation is independent of the school board investigation,” he said. “It is an entirely different matter. The two investigations are not tied together in any way.”

Day did not return telephone calls seeking comment Monday night. He was not present at the city council’s regular meeting.

School board member Bob Chilmonik said Monday night that he had no information regarding an investigation, but added that he would be unable to comment on the matter if he did.

A telephone message left for Superintendent James Browder went unanswered Monday night.

Day was elected to the city council in 2000 and was re-elected for a second term in 2005. According to the city’s Web site, his term expires in November.

Since 2002, Day has been the director of the Southwest Florida Criminal Justice Academy/Fort Myers Fire Academy, the site states. He was a regional representative of the Florida Department of Law Enforcement for five years.
