A Cape Coral man charged in connection to a marijuana grow house bust last year was recently sentenced to three years in prison.
Dayron Javier Marquez, 32, of 1405 N.E. 23rd Place, pleaded no contest in February to one count of trafficking in cannabis more than 25 pounds and possession of paraphernalia. He was adjudicated guilty on both of the charges.
Marquez was sentenced to three years incarceration and was ordered to pay a $50,000 fine, all court costs and $100 to cover prosecution, according to Samantha Syoen, spokeswoman for the State Attorney’s Office. His driver’s license will be suspended for two years.
Assistant State Attorney Nicole Lirra prosecuted the case.
On Feb. 16, 2010, detectives with the Cape police’s Vice, Intelligence and Narcotics Unit executed a search warrant at 2114 N.E. 23rd Place. They located a two-bedroom grow operation on the south side of the residence.
The rooms contained 22 nearly mature marijuana plants, while the guest bedroom contained 19 clones, or small marijuana plants. The pre-packaged weight of the mature plants was 123 pounds, a street value of $80,000.
Marquez was arrested and charged. He was booked into the Lee County Jail on one count of trafficking in marijuana in excess of 25 pounds or 300 plants or more and one count of narcotic equipment possess manufacture deliver.
