Homicide ruled justifiable
A homicide case earlier this year in Lehigh Acres has been closed as justifiable.
At approximately 10:15 p.m. Feb. 11, Lee County Sheriff’s Office deputies were called to 1036 S. Gunby Ave. When they arrived, they found Gary Helms, 52, on the floor deceased.
The Major Crimes Unit conducted a thorough investigation and on March 18 forwarded the case to the State Attorney’s Office of the Twentieth Judicial Circuit.
On March 24, the State Attorney’s Office completed its review and determined the case constitutes a justifiable homicide and declined prosecution of Anita Borcher, 50.
The investigation revealed that Borcher acted in self defense that evening when confronted by her husband, Helms, who was in a rage. Borcher stated she was in fear for her life during the altercation.
According to the SAO’S finding, Borcher was justified and acted within the scope of the law in using deadly force to defend herself.
The Helms family has been contacted by the lead detective and advised of the SAO’s findings.
