Fort Myers man gets four years in fatal hit-and-run
A driver who struck and killed an 82-year-old man in Cape Coral will serve time in prison.
Gerald Gray, 55, of 4641 Gibson Circle, Fort Myers, was sentenced to four years in prison after pleading no contest on Oct. 11 to the charges of leaving the scene of a crash involving a death and driving while license suspended revoked, according to officials with the State Attorney’s Office.
“The honorable (Lee Circuit) Judge Margaret Steinbeck adjudicated him guilty and sentenced him to 48 months in prison, followed by three years of probation,” spokeswoman Samantha Syoen said.
Gray must complete 100 hours of community service and pay various court fines and fees.
“His driver’s license was suspended for life,” Syoen added.
Assistant State Attorney Martin Stark handled the case.
Assistant Public Defender Ryan Downey represented Gray.
He noted that his client pleaded no contest.
“There’s no formal admission of guilt,” Downey said.
“He just chose to not fight the case after discussions,” he added.
According to Downey, the sentencing was part of a plea agreement with the state.
“We thought it would be in his best interest to enter a plea, rather than proceed to trial,” he said. “So that’s the option we chose.”
On Oct. 22, 2015, Gray was arrested and charged with hit and run fail to stop remain at crash involve death and knowingly drive while license suspended revoked in the death of Donnell L. Strum, 83.
The day before, Strum walked out of the front doors of the RaceTrac at 2607 S. Del Prado Blvd. at about 1:59 p.m. and headed toward the gas pumps. Having finished fueling up the Dodge Ram that he was driving at one of the pumps, Gray drove the truck through the parking lot and made a left turn.
During the turn, Gray struck Strum head on, knocking him to the ground and driving over him.
After driving over Strum, Gray stopped the Dodge about 20 feet away. He exited the driver’s seat and looked at Strum, who was lying on the ground hurt. Witnesses yelled that he had ran over the man.
Gray immediately got back in the truck and fled the scene.
Police reported that Strum sustained fatal injuries in the accident and died on scene.
